Terms and Conditions
Terms and Conditions for services provided to customers of Archive Mole (archivemole.com). Before any services are delivered, you must complete the separate Terms and Conditions form by ticking the acceptance box to confirm your agreement.
1 Turnaround times

1.1 The turnaround time is largely dependent on the nature of the task. In general, the task will be completed more quickly if you (the customer) provide precise information (e.g. accurate file names and numbers) during the booking stage. We will keep in touch with you throughout the process to ensure that you remain in control at all times.
2 Copyright, permissions and reuse

2.1 Archive Mole supplies digital copies of records strictly for your own private study, non-commercial research, or education.

2.2 It is your responsibility to ensure that you comply with copyright law and with the requirements of the institution that holds the records (see below). If you wish to reproduce copies in any form of publication, broadcast, exhibition, online display, or other public use, you must first obtain the relevant permissions from the rights holder.

2.3 The National Archives

2.3.1 The reproduction of copies of non-Crown copyright records held in The National Archives will probably require permission from the copyright owner.

2.3.2 You may reproduce copies of Crown copyright records held in The National Archives for purposes of private study, non-commercial research, or education without limitation. Educational use includes use for teaching, preparation for teaching, and examination, by either teacher or student.

2.3.3 You must obtain permission from the Image Library of The National Archives for the reproduction of copies of records, which are protected by Crown copyright for publication, on the internet, for broadcasting, for exhibition, or for any commercial purpose.​

​2.4 British Library​

2.4.1 Copies of materials held at the British Library should only be used for non-commercial purposes and must be properly acknowledged and attributed.

2.4.2. This policy applies even where:​

the underlying content is within public domain;
-
the act of copying itself was justified under an exception to copyright;

rights holders in the material have themselves already issued permissions or a licence for the copied material to be reproduced, commercially or otherwise.

2.4.3 ​Where use of copied material is non-commercial, you are permitted to make use of such content in a manner permitted by UK law.

2.4.4 If you desire to use copies of materials held at the British Library on a commercial basis, you will need to seek the express permission of the British Library to do so in addition to clearing any rights in the material where it remains within copyright.

2.5 For records obtained from other archives or libraries, you must comply with the copyright and reuse policies of the holding institution.
3 Restrictions

3.1 Archives, libraries and record offices exclude certain materials from self-service photography. It is your responsibility to ensure that the requested materials can be photographed.
4 Payments

4.1 We will not begin work on any tasks until satisfactory payment has been received.

4.2 Payment will be requested once all aspects of the service have been agreed and arranged.

4.3 Payment can be made by credit card, debit card, bank transfer, or PayPal by following the instructions in our invoice email.

4.4 Most of our services are charged at a £135 per half day, with alternative pricing options available for some services.

5 Right to cancel

5.1 You have the right to cancel a task at any time prior to completion.

5.2 If the task is in progress then we will invoice accordingly for the work already completed.
6 Delivery

6.1 For the Document Copying service, we will send you digital photos of the requested materials as soon as possible after the final day of the research trip.

6.2 We will send all files via your preferred storage service (e.g. OneDrive, Google Drive).

6.3 For other services, we will send all files via your preferred storage service or, if possible, email.

7 Refunds

7.1 Our team have been conducting archival research for over twenty years, so we know what is and what is not a user error. We endeavour to produce the best quality photographs of any materials, though the quality of the photos will always be restrained by the quality of the original material and conditions in the archives. We are also very fair and if there is a genuine fault with any of our work, we are happy to negotiate a refund with you.
8 Governing Law and Jurisdiction

8.1 These Terms and Conditions, and any disputes or claims arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

8.2 You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any disputes or claims arising out of or in connection with these terms.

9.1 These Terms and Conditions are subject to change at any time without prior notice.

9.3 Your continued use of our services following any changes indicates your acceptance of the amended terms.
